Definitions

  1. "Online booking" refers to booking your child into a block booking via ‘Bookwhen’ through the MH website.
  2. "Carer" means the person who is responsible for the childs welfare.
  3. Mini Handball will be referred to as ‘MH”.
  4. "After School Club" will be referred to as ‘ASC”
  5. "Coach" means the individual engaged by MH to run After School Clubs. Whilst
  6. every effort will be taken to maintain the consistency of the Coaches during the classes,
  7. ‘MH’ retains the right to retain the right to change the coaching staff where
  8. necessary.
  9. "Block fees" means the value chargeable to attend classes for a 6 week block, as specified on the website.
  10. "Parent" means a parent or legal guardian of the child who will be responsible for the payment of the fees and who is the contracting party to this contract and who shall (if the Carer is not the Parent) be responsible for compliance with these Terms & Conditions by the Carer.
  11. "Venue" means the premises where the ‘ASC’ takes place.
  12. " Mini Handball Ltd as named on the website, the company or person with whom you have entered into this contract in respect of the provision of the After School Club.
  13. “Term" means the agreed dates on the website and as described under "Info & Booking" on the Website.
  14. "Terms & Conditions" means the terms and conditions set out in this document and any special terms and conditions agreed in writing by MH and the Parent.
  15. "Website" means the website at minihandball.co.uk
  16. “MHL” refers to The Mini Handball League.

Booking and Acceptance

  1. All agreements and issues relating to the running of the ASC by MH to the child and the on-going communication with Coaches and management are subject to the Terms & Conditions to the exclusion of all others.
  2. No variation or addition to the Terms & Conditions shall be binding unless agreed in writing by Mini Handball  and the Parent.
  3. These Terms & Conditions shall be deemed to be accepted by the Parent and the Carer once the box is ticked on the registration and confirmation of payment of Fees has been received by Mini Handball
  4. Mini Handball may cancel this contract at any time before the child commences a
  5. new block booking, for any reason whatsoever. Mini Handball shall not be responsible for any loss or damage whatsoever arising from such cancellation but will refund fees paid for the remainder of the block booking.
  6. All sessions will be booked online www.minihandball.co.uk via the “Bookwhen’ software.
  7. All ASC bookings are for 6 weeks in line with school half terms.
  8. Fees for ASCs include entry into the ‘MHL”
  9. MH staff will take responsibility of all children booked into an ASC for the duration of the defined session times. Parents/ Guardians/ Carers should ensure children are collected on time at the end of their session. In the event of an emergency, please contact the school and message your assigned coaching contact.
  10. During the online booking process, the Parent will be required to read and acknowledge the following policies set out by MH:

    • Terms and conditions
    Child Code of Conduct
    Parent Code of Conduct
    MH Safeguarding Policy
    MH Privacy Policy
    Staff Code of Conduct

  11. All Children and Parents and Staff are required to abide by the MH Code of Conducts at all times. Failure to do so will result in disciplinary action.
  12. Each member of MH staff will have the following certificates:

    Relevant and appropriate coaching qualification.
    Current DBS Check
    Current Safeguarding certificate
    Current 1st Aid Certificate
  13. All MH staff will receive regular CPD to ensure their qualifications and knowledge are up to date.

Confidentiality

  1. By agreeing to these Terms & Conditions the Parent and/or Carer agrees not to share any aspects of Mini Handball with a third party who may be involved in a business that operates in the same market as Mini Handball .The Parent and/or Carer will not be involved directly or indirectly with such a company.
  2. The Parent and/or Carer will not take, replicate or use any Mini Handball material directly or indirectly for his/her own use or for use by any third party.
  3. The Parent and/or Carer agree not to directly or indirectly be involved or interested in the any business which competes with Mini Handball while the child is a participant of Mini Handball

Parent/Carer Obligation

  1. The Parent warrants that the information provided when registering on the website is accurate and up to date in all respects at the point of booking. Any changes will be sent by the Parent and/or Carer to Mini Handball immediately.
  2. It is the Parent and/or Carer's responsibility to inform Mini Handball of any relevant medical or health conditions at the point of booking. 
  3. The child should not attend any After School Club whilst suffering from any serious illness or contagious disease or anything similar thereto.
  4. Mini Handball shall have the sole right to exclude the child either permanently or for such period as Mini Handball shall (in its entire discretion) determine if deemed necessary for the safety and wellbeing of other participants.

 Limitation of Liability

  1. The Parent and/or Carer agrees that any claim made against Mini Handball will be made in writing within 30 days of the incident taking place and failure to report in writing within this time will negate any such claim.
  2. The maximum aggregate liability for Mini Handball to the Participant, Parent and/or Carer will not exceed the fees.
  3. Mini Handball nor any coach, coaches assistant nor any employee, agent or other representative accepts responsibility in respect of loss, damage or expense incurred by a child, Parent and/or Carer arising directly or indirectly or in any way connected with the attendance of the child, Parent and/or Carer at classes or any other act or omission on the part of MH, its Coaches, coaches assistants, employees, agents and/or representatives.
  4. All warranties and conditions whether implied by statute or otherwise are excluded from this contract provided that nothing in this contract shall restrict or excluded liability for death or personal injury caused by the negligence of Mini Handball, its coaches, coaches assistants, employees, agents and/or representatives or affects the statutory rights of the parent or child.
  5. The parent and/or Carer agrees that any product purchased from the Mini Handball merchandise store is to be used at their own risk. Mini Handball will not accept responsibility for any personal injury which may occur due to improper use. As a consequence, Mini Handball recommends that all equipment is used under the supervision of a Parent/Carer. 
  6. MH do not accept liability for any loss or damage to a child's belongings during their session.

Fees & Payment

  1. The Parent shall pay the fees for the block booking to Mini Handball prior to the child commencing a block booking.
  2. The block booking fees are not refundable in any circumstances whatsoever other than with the written consent of Mini Handball.
  3. If the child misses a session they will not be entitled to a session as a result.
  4. If there is an issue with the venue that is deemed to be out of Mini Handball control, then

Mini Handball can cancel a class and is not obligated to provide a refund or credit but will make all reasonable efforts to reschedule or refund for that session. Mini Handball will make every effort to contact all parents with the contact details we have available.

General

  1. By agreeing to these terms and conditions the Parent consents that the data provided (nonfinancial) can be shared within Mini Handball.
  2. The Parent shall indemnify and keep indemnified Mini Handball against all loss (including loss of profit), liability, cost and expenses which Mini Handball may incur directly or indirectly as a consequence of any action or inaction of the Parent, Carer and/or Participant.
  3. Any notices to be sent by either party to the other shall be sent by pre-paid recorded delivery or hand delivered to the address of the relevant party and shall be deemed to have been received by the addressee within 48 hours of posting or immediately if hand delivered.
  4. The failure by either party to enforce at any time or for any period any one or more of the obligations arising under this contract shall not be a waiver of them or of the right at any time subsequently to enforce any or all of such obligations.
  5. These terms and conditions constitute the entire agreement between the parties hereto and supersedes prior agreements and understandings between the parties.
  6. This contract shall be governed by the laws of England and the parties submit to the exclusive jurisdiction of the English courts.

Marketing

Mini Handball may from time to time take photographs/film of any of MH activity. Any data will be solely for the purpose of promoting and publicising MH activities through our literature, website, social media platforms including and not limited to Facebook, Twitter, Instagram.

Parents/ Carers that do not wish for their child to be photographed and/or included in MH marketing should inform MH at time of booking.
